MISSISSIPPI CODE OF 1972

SEC. 49-7-29. Wholesale minnow dealers.

(1) This section shall be known as the "Mississippi Wholesale Minnow Dealers Law of 1962."

(2) Definitions. For the purposes of this section, the following definitions shall apply:

(a) The term "wholesale minnow dealer" means any person selling minnows to a person for resale.

(b) The term "person" means any person, firm or corporation.

(c) The term "minnow" means any fish commonly used for bait purposes; provided, however, the term "minnow" does not include shrimp.

(d) The term "dealer" means a licensed wholesale minnow dealer.

(3) The department in the public interest of the game and fish resources of this state, shall license wholesale minnow dealers, as herein defined, upon the conditions hereinafter set forth. However, bona fide residents of Mississippi growing minnows on their own property within Mississippi shall be exempt from this section.

(4) It is unlawful for any person except those exempted by subsection (3) hereof to sell minnows at wholesale within the State of Mississippi without the license provided for in subsection (3).

(5) Each sale in violation of this section shall be punishable as a Class I violation as provided in Section 49-7-141.

(6) Each wholesale minnow dealer to be licensed shall certify that he is a resident of the state, on a form which shall be prescribed by the commission and shall apply to the department for a commercial fishing license.

(7) Nonresident wholesale minnow dealers shall apply to the department for a nonresident commercial license upon a form prescribed by the department. This license fee shall be set by the department.
