SEC. 49-15-98. Operating commercial fishing vessel at night without using or displaying lights; penalties.

(1) It is unlawful for any person, commercial fisherman, firm or corporation to operate a commercial fishing vessel, between the hours of sunset and sunrise during a closed season or in a closed area without using or displaying the lights, which comply with all federal regulations applicable to vessels of its classification.

(2) Any person, firm or corporation violating this section shall be fined not less than Two Hundred and Fifty Dollars ($250.00) nor more than Five Hundred Dollars ($500.00) for the first offense, and not less than Five Hundred Dollars ($500.00) nor more than One Thousand Dollars ($1,000.00) for the second offense when the offense is committed within a period of three (3) years from the first offense; and not less than Two Thousand Dollars ($2,000.00) nor more than Four Thousand Dollars ($4,000.00) or imprisonment in the county jail for a period not exceeding thirty (30) days for a third or subsequent offense when the offense is committed within a period of three (3) years from the first offense.

(3) Any person convicted and sentenced under this section shall not be considered for suspension or other reduction of sentence.
