MISSISSIPPI CODE OF 1972

SEC. 37-33-13. Definitions.

As used in the Vocational Rehabilitation Law:

(a) "State board" means the State Board of Rehabilitation Services;

(b) "Office" means the Office of Vocational Rehabilitation of the State Department of Rehabilitation Services;

(c) "Executive director" means the Executive Director of the State Department of Rehabilitation Services;

(d) "Director" means the Director of the Office of Vocational Rehabilitation;

(e) "Handicap" means a physical or mental condition which constitutes, contributes to or if not corrected will probably result in an impairment to occupational performance or independent living capacity;

(f) "Disabled individual" means any disabled person who has a substantial handicap;

(g) "Vocational rehabilitation" and "vocational rehabilitation services" mean any services, provided directly or through public or private instrumentalities, found by the director to be necessary to enable a disabled individual to overcome his handicap, and to enable him to engage in an occupation or live more independently, including, but not limited to, medical and vocational diagnosis; vocational guidance, counseling and placement; rehabilitation training; supported/transitional employment services; physical restoration; transportation; attendant services; occupational licenses; placement equipment, supplies and tools; maintenance; and training equipment, books and materials;

(h) "Rehabilitation training" means all necessary training provided to a disabled individual to enable him to overcome his handicap, including, but not limited to, manual, preconditioning, prevocational, vocational and supplementary training and training provided for the purpose of developing occupational and/or independent living skills and capacities;

(i) "Supported/transitional employment services" means special services provided to individuals with severe disabilities in integrated work environments with the collaboration of a third-party agency that will provide support assistance to the individual potentially for the full term that the individual remains on the job;

(j) "Physical restoration" means any medical, surgical or therapeutic treatment necessary to correct or substantially reduce a disabled individual's handicap within a reasonable length of time including, but not limited to, medical or nursing services, hospital care, convalescent home care, drugs, medical and surgical supplies, and prosthetic appliances; however, curative treatment for acute or transitory conditions is excluded;

(k) "Prosthetic appliance" means any artificial device necessary to support, to take the place of a part of the body, or to increase the acuity of a sense organ;

(l) "Attendant services" means assistance provided in the form of an attendant in an individual's home or other abode that includes any help with daily living activities;

(m) "Occupational license" means any license, permit or other written authority required by any governmental unit to be obtained in order to engage in an occupation;

(n) "Maintenance" means money payments not exceeding the estimated cost of subsistence during vocational rehabilitation;

(o) "Regulations" means regulations made by the executive director with the approval of the state board.
