SEC. 37-33-93. Establishment by Independent Living Center of attendant care program for severely, physically disabled persons.
(1) The Independent Living Center of the Division of Vocational Rehabilitation of the State Department of Rehabilitation Services is hereby authorized to establish an attendant care program to serve the severely, physically disabled. Said program may serve not to exceed one hundred (100) physically disabled persons, eighty percent (80%) of whom shall be persons who are quadriplegic and fifty percent (50%) of whom shall be employed or be employable and seeking employment. Provided, however, that said percentage and employment restrictions shall not apply to attendant care services delivered by a center for independent living and funded with federal matching funds through a cooperative agreement with the Division of Medicaid. The limitation on the number of persons who may be served by this program shall not prohibit the serving of more than one hundred (100) persons under the program, provided that any persons served in excess of such limitation shall not be funded with state funds.
(2) Persons eligible for said program shall be any person who has:
(a) A severe physical disability that requires attendant care service to perform activities of daily living, i.e. bathing, dressing;
(b) Has submitted an application to the Independent Living Center of the State Department of Rehabilitation Services;
(c) Is a resident of the State of Mississippi; and
(d) Is certified to be eligible by an Independent Living Center counselor.
