SEC. 53-7-11. Rules and regulations; surface mining and reclamation operations; public hearing; notice.

No later than ninety (90) days following the effective date of this section the commission shall promulgate proposed substantive and procedural rules and regulations pertaining to surface mining and reclamation operations to implement the provisions of this chapter. However, before adopting such rules and regulations, the commission shall hold a public hearing. Notice of the date, time, place and purpose of the hearing shall be given thirty (30) days prior to the scheduled date of the hearing as follows:

(a) By mail to all operators known by the commission to be actively engaged in surface mining;

(b) By mail to persons who request notification of such proposed regulations;

(c) By mail to the State Soil and Water Conservation Commission and to each of the local soil and water conservation districts;

(d) By mail to the Mississippi Department of Environmental Quality, Mississippi Department of Wildlife, Fisheries and Parks, Mississippi Forestry Commission, Board of Trustees of the Mississippi Department of Archives and History, Mississippi Transportation Commission, * * * Mississippi Agricultural and Forestry Experiment Station and to any other state agency whose jurisdiction the commission feels the surface mining operations may affect; and

(e) To other interested parties by publication once weekly for three (3) consecutive weeks in at least three (3) newspapers having general circulation in the State of Mississippi. Any person shall be entitled to submit written comments or to appear and offer evidence at such public hearing. The commission shall consider all comments and relevant data presented at such hearing before promulgation and publication of permanent rules and regulations under this chapter.
