SEC. 37-7-453. Resolution required for sale; procedure to sell, or return, land to county or municipality.
When the school board of any such school district shall desire to sell any such property it shall pass a resolution declaring that such property is not needed or used for school purposes, and said board shall direct, in such resolution, that same be advertised for sale upon competitive bids in the manner provided in Section 37-7-455. Provided, however, subject to the approval of the State Board of Education, the school board of such school district may elect to sell such lands to the county in which the same are located, or, if the lands are in an incorporated municipality, to such municipality, at a value determined by two (2) qualified appraisers. Provided, further, if the lands were acquired by such school district or its predecessor by donation from a county or municipality, subject to the approval of the State Board of Education, the lands may be reconveyed to the donor or its successor without consideration. Nothing in this provision shall permit the transfer of any lands subject to Section 211 of the Constitution of the State of Mississippi.
