SEC. 37-37-13. Reduction in state minimum education program fund allocations.
(1) If the State Auditor finds that the average of at least six (6) audits made under the provisions of this chapter shows that the number of students enrolled and in actual attendance in any school, or the number actually transported, is as much below the number reported to the State Department of Education for the scholastic year as the percentage shown in Section 37-37-11 for the applicable scholastic year, then the State Auditor shall certify the same to the State Department of Education. The State Department of Education shall thereupon reduce the amount of state funds allotted to the school district from the minimum education program fund for the ensuing scholastic year as follows:
For each school whose reported average daily attendance is in excess of one hundred three percent (103%) of the average number of students actually counted by the examiners, the State Department of Education shall use one hundred three percent (103%) of the average count by the examiners as the average daily attendance for this school in allotting teacher units for the next school session.
(2) Where the allotment of state minimum education program funds to any school district is reduced under the provisions of this chapter, such reduction shall be applied, within the school district wherein such reduction is applicable, only to those schools where the discrepancy is found to exist and shall not be applied to other schools within the district. However, the pro rata part of such reduction that is applicable to school district-wide operations of the minimum education program shall apply to the district as a whole.
