SEC. 41-41-5. Relationships included within those authorized to consent; sufficiency of consent; reliance on representations.

The provisions of sections 41-41-3 to 41-41-11 shall be liberally construed, and all relationships set forth in section 41-41-3 shall include the adoptive, foster and step-relation as well as the natural relationship, the relationship by the halfblood as well as by the whole blood, the relationship by common-law marriage as well as by ceremonial marriage; the illegitimacy of either party or both shall be no bar to a consent by a brother or sister.

A consent by one person so authorized and empowered shall be sufficient notwithstanding another person so authorized and empowered shall refuse or decline to consent or shall protest against the proposed surgical or medical treatment or procedures.

Any person acting in good faith and not being placed on inquiry shall be justified in relying on the representations of any person purporting to give such a consent, including, but not limited to, his identity, his age, his marital status, his emancipation, and his relationship to any other person for whom the consent is purportedly given.
