SEC. 49-23-3. Definitions.
As used in sections 49-23-1 to 49-23-29:
(a) "Interstate system" means that portion of the national system of interstate and defense highways located within this state, as officially designated, or as may hereafter be so designated, by the state highway commission, and approved by the Secretary of Commerce, pursuant to the provisions of Title 23, United States Code, "Highways."
(b) "Primary system" means that portion of connected main highways, as officially designated, or as may hereafter be so designated, by the state highway commission, and approved by the Secretary of Commerce, pursuant to the provisions of Title 23, United States Code, "Highways."
(c) "Great River Road" means that portion of highway located within this state as officially designated by the Federal Highway Administration pursuant to the provisions of Title 23, United States Code, "Highways."
(d) "Outdoor advertising" means by outdoor signs, display, light, device, figure, painting, drawing, message, plaque, poster, billboard, or other thing which is designated, intended or used to advertise or inform, any part of which is visible from any place on the main-traveled way of the interstate or primary highway system or the Great River Road
(e) "Safety rest area" means an area or site established and maintained within or adjacent to the right-of-way or under public supervision or control, for the convenience of the traveling public.
(f) "Information center" means an area or site established and maintained at safety rest areas for the purpose of informing the public of places of interest within the state and providing such other information as the state highway commission may consider desirable.
(g) "Maintenance" means repair, replacement, change, renovation or improvement of any outdoor advertising device as defined herein. Maintenance shall not include the removal or destruction of any outdoor advertising device.
(h) "Erect" means to construct, build, raise, assemble, place, affix, attach, create, paint, draw, or in any other way bring into being or establish.
(i) "Business area" means any part of an adjacent area which is at any time (1) zoned industrial or commercial under the authority of any law of this state, which shall include, without limiting the generality of the foregoing, zoning districts customarily referred to as "B" or business, "C" or commercial, "I" or industrial, "M" or manufacturing and "S" or service and all similar classifications; or (2) not so zoned, but which constitutes an unzoned commercial or industrial area as herein defined.
(j) "An unzoned commercial or industrial area" is a business area determined by actual land uses which is commercial, industrial, marketing or mercantile, along an interstate or primary highway and extending outward along one (1) side of such highway not more than eight hundred (800) feet from the edge of such activity.
