MISSISSIPPI CODE OF 1972

SEC. 51-35-213. Assurances to Secretary of War.

The board of commissioners of any flood control district organized under the provisions of this article is authorized and empowered to give satisfactory assurances to the Secretary of War that it will (a) furnish and make available the necessary rights of way for levees and drainage ditches for the headwater area; (b) maintain the levees in the backwater area in accordance with provisions of section 3 of the Flood Control Act of May 15, 1928; (c) not raise the levees in the backwater area above the limiting elevations established therefor by the chief of engineers; (d) agree to save, release, and hold harmless the United States from all damages resulting from or occasioned by the construction of the works or improvements in the headwater or the backwater area as authorized by flood control acts heretofore or hereafter passed by the Congress of the United States.

1997 Amendment

 SECTION 12. Sections 51-35-195, 51-35-197, 51-35-199, 51-35-201, 51-35-203, 51-35-205, 51-35-207, 51-35-209, 51-35-211 and 51-35-213, Mississippi Code of 1972, which require the district to continue after completion of the plan, authorize the Board of Commissioners to exercise certain police powers and to compel the performance of a duty by mandamus, provide penalties for certain acts, provide for interpretation of this article, identify the relationship between flood control districts and drainage districts, establish a procedure to perfect a defective notice, authorize the board of Commissioners to pay taxes on certain exempt lands and provide certain assurances to the United States Secretary of War, and limit the ad valorem tax assessed under this article, are repealed.
