SEC. 53-9-13. Creation of surface mining and reclamation operations section.
(1) There is hereby created and established a surface mining and reclamation operations section in that division of the bureau which has general jurisdiction over geological studies and surveys.
(2) The section shall have a chief administrative officer who shall be a geologist, hydrologist, agronomist or forester, or a mining, civil, geological or environmental engineer, who shall have a minimum of five (5) years' professional experience with at least one (1) year's experience in an area related to surface mining. The administrator, acting with the approval of the chief and the director, shall propose to the commission such rules and regulations as may be necessary to carry out the provisions and purposes of this chapter. The administrator shall also issue or deny permits to engage in surface coal mining operations pursuant to sections 53-9-21 and 53-9-23 and will perform such other functions as this chapter, or the commission by regulation, may prescribe.

SECTION 43. Section 53-9-13, Mississippi Code of 1972, which creates the surface mining and reclamation operations section, is repealed.
