SEC. 65-23-101. Causeways, bridges, or tunnels as to waters opening into the Gulf of Mexico or Mississippi Sound.
The state highway commission of the State of Mississippi is hereby authorized and empowered to construct, acquire, improve, operate, and maintain causeways, bridges, tunnels, toll bridges, or any combination of such facilities, including all necessary approaches, fixtures, accessories, and equipment, over, under, and across any tide water bay, bayou, or river tributary of the Gulf of Mexico or Mississippi Sound, and which opens into the Gulf of Mexico or Mississippi Sound, wholly within the territorial limits of the State of Mississippi (all of which or any combination of which, regardless of whether the facilities so combined are related or geographically connected, are hereinafter referred to as the "project") from one point in the state to another, and to issue its revenue bonds payable from the revenues to be derived from the operation thereof, to pay all or part of the cost of such construction, acquisition, or improvement. The cost of the project shall be considered to include the cost of construction; the cost of all property, real, personal and mixed, and all appurtenances, easements, contracts, franchises, pavements, and properties of every nature, used or useful in connection with the construction, acquisition, improvement, operation, and maintenance of the project; the payment of the cost of condemning any such property, including both the payment of the award and the payment of the court costs and attorneys' fees; the payment of all legal, fiscal, and engineering expenses incurred in connection with the acquisition and construction of the project, the making of preliminary surveys and investigations, and the authorization and issuance of the revenue bonds; and the payment of interest on the bonds prior to and during the period occupied by the construction of the project and for one year thereafter. Nothing herein contained shall authorize the issuance of bonds for the purchase of bridges presently existing or under construction.
