SEC. 69-2-45. Farm Mediation Office; voluntary nature of mediation.
The Commissioner of Agriculture and Commerce shall establish a voluntary Farm Mediation Office within the Department of Agriculture and Commerce. The Farm Mediation Office shall provide mediators by contracting with qualified persons experienced in farm finance, agricultural law and negotiation. The Farm Mediation Office shall provide training and support for mediators. The Commissioner of Agriculture and Commerce may appoint a farm mediation administrator and may adopt rules necessary for the administration of the program. The commissioner may adopt rules prescribing appropriate fees for the mediation services authorized by this chapter. The Department of Agriculture and Commerce may accept monetary or in-kind contributions, gifts and grants provided to support the Farm Mediation Office. Mediation shall commence within forty-five (45) days of a properly completed mediation request unless delayed upon mutual consent of the parties. Mediation shall be voluntary and neither creditors or debtors shall be under any obligation, "good faith," or otherwise to participate in mediation.
