SEC. 75-31-7. Sales unlawful; inspection.
Sections 75-31-1, 75-31-3, 75-31-5, 75-31-6, 75-31-7, 75-31-9, 75-31-11, 75-31-13, 75-31-15, 75-31-17, 75-31-19, 75-31-21, 75-31-23, 75-31-25, 75-31-27, 75-31-29, 75-31-31, 75-31-33, 75-31-35, 75-31-37, 75-31-39, 75-31-40, 75-31-41, 75-31-43, 75-31-45, 75-31-47, 75-31-49, 75-31-51, 75-31-53, 75-31-55, 75-31-57, 75-31-59, 75-31-61 and 75-31-63, Mississippi Code of 1972, which provide for the regulation of milk and milk products by the Commissioner of Agriculture and Commerce, are repealed.
(1) It shall be unlawful for any person engaged in the business of handling or sale of milk or cream or the by-products of same, or in the preparation, manufacture, sale or offer for sale of any food products for man from milk or cream or the by-products of same to maintain his premises or utensils in an unsanitary condition, or to knowingly sell, offer for sale, or keep for sale milk or cream drawn from sick or diseased cows or goats, or cows or goats kept in an unsanitary place or cows or goats fed on unwholesome feeds or slops, or cows or goats furnished unwholesome or unclean water to drink.
(2) The Commissioner of Agriculture and Commerce, his agents or assistants shall have free access to any barn or stable where milk cows or goats are kept or milked, or to any factory, building, dairy or premises, where any dairy product is manufactured, handled, stored, or sold, or where they suspect that oleomargarine, or other substance designed to be used as a substitute for butter, or other imitation butter or imitation cheese are being manufactured, kept, sold, delivered, transported, or stored in violation of this chapter.
(3) It shall be unlawful for any person, or the agent of any person, firm or corporation to prevent or interfere with the duly authorized inspector or agent of the State Commissioner of Agriculture and Commerce from entering or inspecting any place or premises where milk or milk products or where oleomargarine or imitation butter or cheese or renovated butter or any substance designed to be used as a substitute for butter, are purchased, manufactured, prepared, sold, kept for sale, furnished or served, or to prevent or to interfere with such inspector or agent in the event he deems it advisable to secure samples of milk or milk products, or oleomargarine, or imitation butter or cheese or renovated butter or any substance designed to be used as a substitute for butter, at or from any such place or person, for the purpose of ascertaining whether this chapter is being violated, or to interfere with or prevent any such inspector or agent from examining any records or books required by the provisions of this chapter.
