MISSISSIPPI CODE OF 1972

SEC. 75-31-137. Commissioner of agriculture and commerce to administer and enforce; powers and duties.

The responsibility for the administration and enforcement of sections 75-31-125 through 75-31-151 is vested in the commissioner of agriculture and commerce. His responsibilities shall include, but not be limited to, the following:

(a) To establish and promulgate minimum standards of milk for use in the manufacture of frozen desserts, its transportation, classification, use and processing, and the manufacture, packaging, labeling, storage and handling of frozen desserts made therefrom.

(b) To license all "frozen desserts manufacturers" and "frozen desserts retail establishments" which manufacture products regulated under terms of sections 75-31-125 through 75-31-151 for sale in the State of Mississippi.

(c) To require the keeping of appropriate books and records by plants licensed under sections 75-31-125 through 75-31-151.

(d) To issue orders of "stop sale" or other actions provided elsewhere in sections 75-31-125 through 75-31-151 for violation of the provisions of sections 75-31-125 through 75-31-151 or the rules and regulations adopted hereunder.

(e) To promulgate and adopt rules and regulations for the inspection, sampling and testing of frozen desserts, the inspection of frozen dessert plants, and for the enforcement of other terms and conditions of sections 75-31-125 through 75-31-151.

1997 Amendment

Sections 75-31-125 through 75-31-151, Mississippi Code of 1972, which provide for the Mississippi Frozen Desserts Act of 1982, are repealed.
