SEC. 75-31-141. Sanitary requirements for frozen desserts and frozen dessert mixes; storage requirements; inspections.
(1) Frozen desserts and frozen dessert mix containing no chocolate, cocoa, fruits, nuts or other bulky flavoring ingredients shall, prior to delivery by the frozen dessert manufacturer or distributor to the retailer or consumer, have a maximum standard bacterial plate count of not more than fifty thousand (50,000) per gram and a maximum coliform count of not more than ten (10) per gram, as determined by three (3) out of the last five (5) official samples.
(2) Frozen deserts and frozen dessert mix containing chocolate, cocoa, fruits, nuts or other bulky flavoring ingredients shall, prior to delivery by the frozen dessert manufacturer or his distributor to the retailer or consumer, have a maximum standard bacterial plate count of not more than fifty thousand (50,000) per gram and a maximum coliform count of not more than twenty (20) per gram, as determined by three (3) out of the last five (5) official samples.
(3) Unless specifically provided elsewhere in sections 75-31-125 through 75-31-151, all frozen desserts or mix shall be stored under such optimum temperatures and humidity as will maintain their quality and condition. Products shall not be exposed to storage conditions such as foreign odors, drippings, condensation, etc., that might cause product or package damage.
(4) Frozen dessert plants shall be inspected at regular intervals, but not less than once each calendar quarter by the commissioner or his representatives.

1997 Amendment
Sections 75-31-125 through 75-31-151, Mississippi Code of 1972, which provide for the Mississippi Frozen Desserts Act of 1982, are repealed.
