SEC. 75-56-13. Misbranding.

Antifreeze shall be deemed to be misbranded:

(a) If it does not bear a label which:

(i) Specifies the identity of the product,

(ii) States the name and place of business of the registrant or person for whom registered,

(iii) States the net quantity of contents (in terms of liquid measure) separately and accurately in a uniform location upon the principal display panel, and

(iv) Contains a statement warning of any hazard of substantial injury to human beings which may result from the intended use or reasonable foreseeable misuse of the antifreeze. Alcohols and other nonglycolbase materials marketed as antifreeze or engine coolants shall bear labels which describe to the satisfaction of the State Chemist the dangers to the mechanical parts of the equipment it is to be used in, and the hazards to the operators and/or passengers using the equipment, and the chemical composition. The labels shall also bear the numerical values for the following specifications: specific gravity 20/20 degrees centigrade, freezing point of fifty percent (50%) water solution, boiling point of the product, flash point by the open cup method in degrees centigrade.

(b) If the product is to be diluted with another substance for use and the label on a container of less than five (5) gallons, or the labeling for a container of five (5) gallons or more, does not contain a statement or chart showing the appropriate amount, percentage, proportion or concentration of the antifreeze to be used to provide (i) claimed protection from freezing at a specified degree or degrees of temperature, (ii) claimed protection from corrosion, or (iii) claimed increase of boiling point or protection from overheating.

(c) If its labeling contains any claim that it has been approved or recommended by the State Chemist.

(d) If its labeling is false, deceptive or misleading.
