SEC. 97-27-35. Unlawful to sell cigars, cigarettes, smoking tobacco or snuff if not in sealed container; penalties for violations.

It shall be unlawful for any person, partnership or corporation to sell any cigars, cigarettes, smoking tobacco or snuff if such products are not in a sealed container. The sealed container shall be the container in which the cigars, cigarettes, smoking tobacco or snuff are packaged by the manufacturer of same. Any person convicted of a violation of this section shall be fined not less than Fifty Dollars ($50.00) nor more than One Hundred Dollars ($100.00) and may have his permit issued pursuant to Section 27-69-5 revoked, in the court's discretion.
